What Your Vehicle Accident Lawyer Can Do For You

Posted by flo.Belxlanger in May 09, 2010, under Accident Lawyers Articles

In the United States last year, a record number of almost 6,500,000 accidents involving motor vehicles occurred. These accidents have injured people numbering to over 2.9 million and killed almost 42,000.

All over the country, particularly in population-congested states like California, particularly in Los Angeles County, vehicle accidents occur almost every day.

What starts as simple drives or car rides going to the grocery, school or place of work become terrible accidents that bring catastrophic effects to families of individuals involved and the local and state governments. Many lives become irreparably changed.

For people who have been injured because of accidents of various forms like collisions, crashes and rollovers, it is quite devastating to cope with the loss of normal physical function. For those who have endured the loss of loved ones, the pain and anguish may never be forgotten. This is so especially when there are also profound effects on their economic status and lifestyle because of the injury and death.

For victims of vehicle accidents, in LA County in particular, many qualified LA County vehicle accident lawyers offer their services in order to file claims for damages of lives and property or charges to those who were liable or considered “at fault” for the accident.

The process of motor vehicle litigation is one of the specializations of these attorneys. This kind of litigation goes further back from the actual car accident that occurred.

Lawyers with professional skills on this kind of litigation would thoroughly investigate other factors that may have caused the accident. These include the liability of vehicle distributors, parts manufacturers, and retailers and other vehicle accessories and safety gadgets suppliers by looking into the possibility of the vehicle having a defect that was the actual cause of the whole accident.

Litigation processes on vehicle accidents also include launching action against responsible government agencies in charge of designing and maintaining the roadways.

Generally, litigation aims to pinpoint the individual or entity that committed negligent actions or have shown carelessness and disregard of the laws. This is under the general rule that vehicle operators always have to exercise “reasonable care under the circumstances.”

Lawsuits for personal injury involving motor vehicle accidents could be charged against the following:

- Another driver / drivers

- A pedestrian / pedestrians on the sidewalk

- A passenger / passengers in the vehicle

Furthermore, the investigations of a lawyer could bring up some liability issues that can be considered as another case.

The vehicle accident lawyer also pinpoints the causes of accidents in order to come up with the liabilities and persons “at fault” to file a case against. When wrongful action or negligence is proven, the liable parties have to pay monetary recovery and other punitive damages to the injured victim/victims or the family members of victims who were killed in the accident.

Accident Lawyer – Tips You Must Know If You’ve Been Injured

Posted by flo.Belxlanger in May 07, 2010, under Accident Lawyers Articles

If you have been involved in an accident where you were injured, an accident lawyer can answer your questions and help you understand the compensation you may be deserving of. It seems like most people who are injured try to speculate and decide if they think they have a case and if they are deserving of compensation.

I have seen hundreds of people who contact an accident lawyer after a year or two following the accident because their injuries have adversely affected their increasing debt and loss of earnings.

The problem is that most do not realize that even if they have medical insurance, their medical bills and other debt can very quickly get to a point where they simply can not handle them. Than comes the real shocker when many times injuries lead to loss of income because the injured are unable to continue in the job they are accustom.

So if you have been injured what do you do?

The most important thing you should not do is talk to anyone about your accident or injury other than a lawyer. Realize that the person, business or property owner where you were injured is probably already setting up a defense.

Their insurance company has probably already been contacted and they may even try to contact you. They will sound innocent enough and very non-threatening but their intentions are anything but. They want nothing more than to get a statement from you that will be used at a later time to slow down or significantly reduce any compensation you are deserving of.

If they have contacted their accident lawyers they are already getting statements and setting up a defense. If the police or other official agency was involved where the accident was documented, a lawyer is able to obtain all the documentation and contact any witnesses to obtain the necessary statements.

More important is the fact that witnesses stories change over time as they simply do not remember the details of the accident. Again a lawyer is able to obtain all the necessary statements from any witnesses or anyone that may be indirectly involved with your accident and injury.

Another problem we see is that most people will look at their case and decide if they were at fault and from there not move forward in contacting an accident lawyer. That though is exactly why there are lawyers who specialize within specific types of law.

Lawyers know the law, codes and case law and find the specific details about your accident that many times will favor compensation for your injuries. Regardless of your injury there is an accident attorney who specializes within that specific law.

Here are just a few examples of accident lawyers who specialize in a specific type of law:

Car accident lawyer
Traffic accident lawyer
Pedestrian accident lawyer
Hit and Run Accident Lawyer
Boat Accident Lawyer
Construction Accident Lawyer
Personal Injury Lawyer
The above of course is just a few of the many types of accident lawyers who are specialist in their field. There have been many who never expected to receive compensation and yet have won settlements well in excess of $500,000.

The most important fact is not to delay. Compensation in many accidents that have caused injury are deserving of settlements. Don’t allow what we have seen so often with loss of homes, increasing debt and family disputes. Most lawyers will offer you a free consultation with injury cases.

Most importantly contact an accident lawyer who specializes in the specific law your case requires. Those lawyers have a much higher winning percentage and larger settlement amounts for their clients.

Few Words About Car Accident and Compensation Claim

Posted by flo.Belxlanger in May 06, 2010, under Accident Lawyers Articles

Car accidents can turn up to be very dangerous; result depends on the intensity of the accident. Automobile accidents that take place on highways involving heavy weight vehicles like trucks often result in fatality.

Life seems to come to standstill after an accident. Car accident victims and their family members feel helpless to figure it out how to recover. Huge financial outlay for treatment, property damage, reduced income, job loss and mental trauma make life miserable.

Monetary compensation becomes very essential at this point of time. But compensation does not come automatically. Car accident victims need to file compensation claim in court of law. The court then interferes and decides who is responsible for the accident. The sufferings of the victims are calculated and the responsible party is asked to pay the compensation.

All the states have strict car accident laws to protect the rights of the citizens. If you fall prey to car accident, get yourself a senior accident attorney and apply your rights.

When you start searching for car accident lawyers, chances are you would become overwhelmed to see the number of helping hands extended towards you! Do not get nervous. A little bit of knowledge about car accidents and related laws can help you bring the situation in your favor.

How to find a suitable lawyer?

There are hundreds of lawyers in your state; you surely would not hire all of them. While choosing a lawyer look for someone who is specialized in handling the type of case you are going to file. Accident lawyers can help you file lawsuit related to road accident, accident at work, slip and fall accident or any other form of accident

If the accident results in death you may need to consult wrongful death attorneys. Death of a person as a consequence of personal injury, accident or negligence is considered as wrongful death. Family members and keens of the killed person can file compensation claim to recover.

Money crunch is quite common after car accidents. Victims need medical care, damaged car should be repaired and other responsibilities need to be carried out. Now, if the victim is unable to go to work, the family income is going to reduce. It becomes difficult to continue with normal lifestyle with the reduced income.

Then how can you bear the cost of filing a lawsuit? That’s a valid point definitely. You would be glad to know that most personal injury lawyers and accident attorneys work on ‘no win no fee’ or ‘do not pay until you win’ basis. Claimants do not need to pay attorney fees or any set up cost. The accident attorneys collect their fees from the compensation amount on successful completion of the case. Sometimes claimants need to pay court costs initially. So talk to your lawyer and understand the financial matters thoroughly.

To get in touch with competent accident attorneys look at attorney referral websites, local classified columns, directories and Yellow Pages; make a list of local attorneys and then choose the one who is most suitable for your case.

Drunk-Driving, Hit-and-Run, Police Chases – The Road Has Risks For Modesto Residents

Posted by flo.Belxlanger in May 02, 2010, under Accident Lawyers Articles

Modesto, California of Stanislaus County has an extremely high rate of vehicle theft, second only to Las Vegas as of 2007. It seems plausible that the ubiquity of auto theft may be affecting other car accident disasters, particularly issues of hit-and-run, DUI, and the cause of police chases. Any Modesto car accident lawyer will tell you that these are all elements of the road drivers must be aware of in order to stay safe.

Since the beginning of the new year, reckless behavior and car accidents have already taken their toll. Two recent accidents, only about a week apart, have both involved Modesto police officers, strangely enough. One driver was arrested on suspicion of drinking and driving and hit-and-run. The driver ran a red light and hit the front fender of a cop car, spinning the cop car around. Another police officer from a different nearby cop car came over to make sure the other officer was OK. In the meantime, the driver had abandoned his vehicle and fled on foot.

The driver who caused the accident was arrested after a short pursuit. He was found to be under the influence and charged with hit-and-run. The officer from the initial impact suffered minor injuries.

The other accident involved a patrol car and a sports utility vehicle. A witness said the officer was driving too fast, lost control, and slid sideways into the SUV’s lane. This accident took place on Scenic Drive.

Police Chases are a Surprising Cause of Car Accidents

At least 300 people die in police pursuits, particularly car chases, per year, according to a study conducted by Harborview Injury Prevention and Research Center of Seattle. In 2007, a dangerous police chase took place in Modesto and has led to controversies over who was at fault.

A 27-year-old man in a stolen vehicle was pursued by two police cars through heavy traffic. Suspicious activity was reported to the police, and as the police approached, the 27-year-old man fled. The driver reached up to 70 mph on the congested street and was trying to pass a car when he hit another head-on. Two from the impacted vehicle where killed and the passenger in the stolen vehicle died as well.

Any good Modesto car accident lawyer could help sort out the confusion that built up around this accident. Families of the victims who died decided that the fault was not on the man whole stole the vehicle, but rather, the police who chased him through dangerous traffic. They claimed that the Sheriff’s Department is at fault for “improperly chasing [the driver] through North Modesto”, and that the pursuit is what caused the deaths of their loved ones. They have filed two wrongful death lawsuits in Stanislaus County seeking damages against the county as of 2009.

DUI Dangers Affect All

Another 27-year-old Modesto man has been involved in two bicycle accidents, the more recent one resulting in a death. The driver is accused of striking and killing a bicyclist while under the influence of a painkiller and marijuana.

This fatal car accident is especially disappointing because it was this driver’s second offense and he had been called, by the Department of Motor Vehicles, “among California’s worst drivers”. The first accident he was implicated in resulted in the the injury of a boy riding his bicycle across the street in Modesto. He was found under the influence of intoxicants during this accident, as well.

An Overview of Bike Crash Accidents and Bike Crash Lawyers in LA

Posted by flo.Belxlanger in May 01, 2010, under Accident Lawyers Articles

In Los Angeles, where there are many places teeming with pedestrians and cyclists, lawyers that are specializing or are knowledgeable in handling bicycle accidents like bike crashes, are not too hard to find. The only criteria to retain the best are experience and knowledge of the bicycle accident and personal injury laws.

Pedestrians and bicycle riders are usually very vulnerable to sustaining injuries or being killed because of accidents wherein motor vehicles crash, collides or rub over bicycles. The problem is that, even if the cyclist is riding lawfully in the crosswalk or on the green “walk” sign, some car or other vehicle drivers are oblivious of them.

Other drivers are not even aware that their vehicles have rubbed over or hit a bicycle. Some are not aware of the rights of bicyclists on the roads and this ignorance leads to them not being more careful around bicycles in general.

Ever since 2004, the NHTSA or National Highway Traffic Safety Administration released information that there were more or less 5,000 deaths reported as a result of automobile versus pedestrian or bicycle accidents.

The fact that annually, there are more than 78,000 pedestrians and bicycle riders who sustain injuries show that a lot of drivers still have to be educated about being extra careful. In a bicycle crash, the cyclist is the one who suffer greatly, more than the vehicle drivers do. There are no seatbelts, roll cage and air bags.

If you have been injured as a result of a car versus bike crash accident, under the California laws, you are granted with the considerable rights to be compensated for the expenses you incurred and the pain and suffering you felt.

You can be compensated of the medical expenses, future medical treatments and expenses, property damages, lost income, pain and suffering, loss of enjoyment in life for the future, and/or temporary or permanent disability. You can also be granted with punitive damages, wherein the liable and at fault party is directed to give payment as a punishment and warning for their carelessness, ignorance of the laws, and/or obliviousness.

Bike crash accidents in Los Angeles can be found through the internet, yellow pages, and local bar association listings. Whether you find a lawyer who offers his/her services on a contingent fee basis, you will still be spending time and money on filing a case against the party or parties liable or at fault for your accident.

Make sure that you retain the lawyer who has the necessary expertise to handle your case. Keep constant communication and update with him or her. Make sure that you are constantly updated concerning the demands you will put up and the answer to the demands being offered by the other party.

Make sure, too that the bike crash lawyer you hire knows how to deal with insurance companies and adjusters. This will ensure that you get your money and effort’s worth on the settlement and on your case, in general.

Panasonic RP SDW08GU1K – Flash memory card – 8 GB – Class 10 – SDHC

Posted by flo.Belxlanger in Apr 27, 2010, under Panasonic

Panasonic RP SDW08GU1K – Flash memory card – 8 GB – Class 10 – SDHC works as advertised – J. Van Ness –
I use this with my Lumix DMC-ZR1. The 8 gig size holds plenty of pictures combined with video. Used this on a 5 day hiking trip and did not run out of space 300 pictures <10 minutes video. waiting between pictures on camera was not annoying amount of time.
I’ve had a few Panasonic SD cards and have always enjoyed their performance and exceptional reliability.
I tend to shoot with 8 GB cards mostly because they allow a lot of shooting without the risk of putting all your pictures on one card.

I purchased this card and a SanDisk Extreme Class 10 8GB SDHC card and I will give a quick comparison of the two.

Panasonic Pros:
- Looks great. The bright face and case make the card easier to find when it’s buried in your camera bag.
- Has a Memo section on the front and back of the card for labeling purposes. (Although the back part is black)
- Includes a nice-looking sliding case. (Although it is bulkier than the standard cases other SD cards have)
- Priced substantially lower than the equivalent SanDisk.
- Made in Japan (The SanDisk is made in China)
- Very fast read/write speeds.

Cons:
- Not as fast as the SanDisk, although it doesn’t claim to be.

The Panasonic states up to 22 MB/s, whereas the SanDisk claims up to 30 MB/s.

The warranty on the Panasonic is 10 years while the SanDisk has a lifetime warranty. But that is pretty much irrelevant since these cards are only usable for a few years before they are too small or too slow.

My comparison test was shooting with my Pentax K-7 which does 5.2 frames per second. I shot JPG 1/100 of a second and the average file size was 9MB. I was able to shoot 53 shots over a 25 second period with about 12 seconds of writing following. This is quite a bit faster than my previous Panasonic Class 6 cards.

With the SanDisk I was able to shoot 67 shots over 25 seconds with 9 seconds of writing afterward. The SanDisk was clearly faster but unless you are doing constant HD movie recording or using burst mode all the time, you would never notice the difference. The Panasonic is more than fast enough for all normal shooting.

I can’t say the difference in cost is worth the extra speed of the SanDisk. At the time of this review the Panasonic () is – cheaper than the SanDisk.
Overall I highly recommend this card. Like other Panasonic cards I’ve owned, I expect it will be extremely reliable. Panasonic: SDW08GU1K The GOLD line series inherits the advantages of the Class 6 line with further enhanced speed performance. Its Class 10 speed capability combined with intelligent controller is ideal for large volume data recording and transmission in high definition applications. Class 10 is designed to meet the requirement for higher resolution consecutive shooting and large-sized high definition video shooting. It enables to write out large amounts of data continuously up until the card is fully written without missing any shots or writing stops.

Car Accidents and Adverse Weather Conditions

Posted by flo.Belxlanger in Apr 26, 2010, under Accident Lawyers Articles

Throughout Wisconsin and other states in the Midwest, drivers must contend with a climate that subjects them to an array of different adverse weather conditions throughout the year, many of which have the potential to directly cause car accidents or to serve as an enabling factor. This is an inescapable reality of life there, and it is one about which drivers should be properly educated so that they can make wiser decisions behind the wheel in response to the changing state of things on the roadways. The effects of a car accident are likely to be severe and may include serious physical injuries in addition to significant vehicle damage.

Part of the reason that severe weather poses such a notable threat to highway safety is that, although those events occur a number of times each year, most drivers do not have sufficient experience operating a vehicle under those pressures to have developed an awareness and skill set that allow them to react appropriately. As a consequence, motorists may panic or attempt to over-correct. For example, in the midst of a heavy downpour the desire to reach one’s destination as quickly as possible might lead to overly aggressive acceleration. With compromised traction, the driver may immediately lose control of the vehicle as the tires spin and it slides with little regard to the orientation of the steering wheel.

Notable Dangers and Injuries

The threat of heavy rain is something that looms for drivers in many different locales, though obviously it is a more likely occurrence in some places than others. But there are other notable weather dangers for motorists that are more heavily localized. Freezing rains, heavy snow, hail, and ice on the road surface tend to be restricted to specific regions and can turn the highway into a complete and utter mess. Drivers may be unable to accelerate, stop, or turn properly and unexpectedly hitting a patch of black ice can cause a vehicle to skid uncontrollably. Tornadoes pose an entirely different set of problems, but the scattering of debris by high winds is perhaps of the greatest concern.

When another driver’s failure to operate his or her vehicle safely in the presence of adverse weather conditions causes an accident, you may suffer the following injuries:

Fractured bones
Spinal cord injuries
Traumatic brain injuries
Severe contusions
Severe lacerations
Whiplash

Knowing Your Rights
